You have the right to cancel any of order placed with us within seven days of placing it. You will receive a full refund but any work carried out on your project within that time will not be sent to you.
1. This contract is between Donard Ghosts and the client. The client is defined as the person who pays for the service.
2. The writer has agreed to write a piece up to 100,000 words for the client based on material [story brief/other information] supplied by the client to the writer. The decision as to how much of the 100,000 words paid for are used is to be made by the client.
3. The writer has agreed to finish writing the 100,000 words within 16 weeks from the time that payment of [£5000 or $7500] has been made by the client. The 16 weeks period will only begin when the payment has been cleared by the writer’s bank. The client may extend the 16 weeks period by informing the writer of their intention to do so. The writer may only extend the 16 weeks period with the express agreement of the client. A payment of [£2000 or $3000] will be paid by the client to the writer when the client earns £100,000 or $150,000 from the book; a payment of [£2000 or $3000] will be paid by the client to the writer when the client earns £500,000 or $750,000 from the book; a payment of [£2000 or $3000] will be paid by the client to the writer when the client earns £1,000,000 or $1,500,000 from the book.
4. Donard Ghosts will have 12 months from the time that the deposit has been paid to find a suitable publisher for the book.
5. If at the end of the writing process the client requires that part of the work be re-written, reasonable time must be afforded to the writer to complete such a re-write. This re-write time must not exceed two weeks for every ten thousand word section.
6. The writer agrees to keep all claims to the work private unless instructed by law to make such a disclosure to a court or other authority or body with relevant powers to make such a request, and only to those courts or authorities that have an influence or legal standing in the United Kingdom or United States of America.
7. The client agrees not to hold the writer or Donard Ghosts responsible if the identity of the writer with respect to the project becomes public knowledge through theft, interception of e-mails or other correspondence, or through any other circumstances other than the writer or Donard Ghosts purposefully making this information available to the public.
8. The client agrees to allow Donard Ghosts to act as their agent for this project for the period of time specified in point 6 of this agreement, but will not hold the writer or Donard Ghosts responsible should Donard Ghosts fail to secure a publishing contract or other agreement with respect to the project within this time, or at any other time, either agreed or implied.
9. If the writer secures an offer of a publishing agreement for the work which the client declines, the client can not independently, or through a third party, approach the entity that made the offer.
10. Both writer and client agree that this is the only valid contract with respect to this project and that any modifications that both parties agree to with respect to this contract will be done through Donard Ghosts and formalised in writing. Until such a written agreement, signed by both client and writer is received by Donard Ghosts, this contract will remain the only valid contract.
11. Failure by either party to meet in full the terms of this contract may result in the agreement being cancelled. If the agreement is cancelled due to the actions of the writer, the writer must refund the fee paid by the client in full, within 28 days of the agreement being cancelled. If the agreement is cancelled due the actions of the client, the writer nor Donard Ghosts will not have to refund any of the fee paid by the client.
